DETROIT COURT HALTS EVICTIONS!

Michigan Legal Services is proud to stand in solidarity with a broad community coalition to halt evictions during the coronavirus crisis.  We will continue to advocate for our most vulnerable community members.  

36th District Court Chief Judge McConico states, "As everyone is strongly encouraged to practice social distancing and, if applicable, self-quarantine, during this period, it would be unwise and mean-spirited to remove people from their homes until this threat has passed.”

Ms. Jones requested a loan modification from her servicer because the mortgage payments had become unaffordable.  She was eventually granted a trial modification, and made all of her trial payments.  The servicer failed to convert the trial modification to a permanent modification and proceeded to foreclosure.  We represented Ms. Jones and obtained a modification agrement with affordable payments and a significant principal reduction. 

Ms. Bell is a senior citizen who lived in her home for over 50 years. She got behind on her mortgage due to medical expenses and the servicer foreclosed on her home. We represented her and were not successful at the trial level, but mounted a vigorous appeal. We were able to negotiate a settlement that discharged the mortgage completely and now Ms. Bell can enjoy her golden years without worry. 

Ms. James applied for a loan modification after her work hours were reduced.  She received a trial payment plan with payments that were higher than the mortgage she required assistance with.  When she inquired why the payments were higher, the servicer claimed it included mortgage insurance, but Ms. James had always maintained her insurance separately and was current.  The servicer directed her to re-apply but instead proceeded to foreclosure. The eviction case against Ms. James was dismissed and a nonprofit organization was able to purchase her home for her at market value. Ms. James now owns her home free and clear, without any mortgage lien.
